Terms of Service

1. Who you are contracting with
Warmloom is operated by LOULEK COMMUNICATION, a French société à responsabilité limitée (SARL) registered at 17B boulevard Pasteur, 75015 Paris, France, company number 989 763 305 (RCS Paris) (“we”, “us”). By creating an account or using the service, you accept these terms.
2. What the service does
Warmloom finds a company with a recent, public business event, identifies a contact, verifies their email address, writes one personalised outreach email and creates it as a draft in the Gmail account you connect. It can then send that draft at a scheduled time, write follow-ups, and tell you when someone replies.
The service is provided as-is. Finding a prospect depends on public information existing and being findable; we do not guarantee that a search returns a result, nor that any email is delivered, opened or answered.
3. Your account
You need a Google account to sign in, and you must be at least 18 and act in a professional capacity. You are responsible for what happens under your account. Tell us promptly if you think it has been compromised.
4. Your mailbox, your emails, your responsibility
Every email Warmloom creates is a draft in your mailbox and is sent from your address. You remain the sender and, under data protection law, the controller of your own outreach. That means you are responsible for:
- reviewing what goes out: drafts wait at least 24 hours by default precisely so you can read, edit or cancel them;
- complying with the law that applies to you and to your recipients, including the GDPR, the French rules on B2B prospecting, CAN-SPAM in the United States, and CASL in Canada;
- honouring any request to stop, and not contacting someone who has asked you not to.
You must not use Warmloom to send unlawful, deceptive, harassing or bulk unsolicited content, to impersonate anyone, or to contact consumers in a personal capacity. We may suspend an account that does.
5. Deliverability safeguards
We deliberately limit how fast you can send: a daily cap per mailbox, a minimum gap between emails, a sending window, and a refusal to send to any address we could not verify. These limits protect your domain's reputation and are part of the service, not a defect.
6. Free plan and paid plans
Warmloom is free until a prospect replies to one of your emails, within a ceiling of 40 emails. A reply of any kind: including a refusal: counts, because it is the conversation the service exists to start. After that, continuing requires a paid plan. Prices are shown on our pricing page; we will tell you before any change affects you.
Reaching the limit never deletes anything: your replies are in your own Gmail, emails already scheduled still go out, and follow-ups on existing threads continue.
7. Availability and changes
We work to keep the service available but do not guarantee uninterrupted access. We may change or discontinue features; if a change removes something you rely on, we will give you reasonable notice.
8. Liability
To the extent permitted by law, our total liability for any claim relating to the service is limited to the amount you paid us in the twelve months before the claim. We are not liable for lost profits, lost opportunities, damage to your sender reputation, or any indirect or consequential loss. Nothing here limits liability that cannot lawfully be limited.
9. Ending the agreement
You may stop using Warmloom and delete your account at any time. We may suspend or close an account that breaches these terms, that is used unlawfully, or that puts other users' deliverability at risk: with notice where circumstances allow.
10. Governing law
These terms are governed by French law. Any dispute will be brought before the competent courts of Paris, France, subject to any mandatory consumer protection rules that apply to you.
